| 摘 要： | 开放式处遇是指在不影响刑罚执行的情况下,通过取消监狱围墙、铁栅栏、手铐等形式,减少对犯人自由的限制,增加对犯人的信任,以尽可能缩短在押犯同正常社会生活的距离。实行开放式处遇在我国具有必要性与可行性。我国可以采用劳动释放制、学习释放制、归假制等开放式处遇形态。
