| 摘 要： | 中国传统社会的基本法典以明律和清律为代表。明清律的基本结构反映了中国传统文化的典型的法典编纂观念 ,稀少的民事规范在律典中杂附于刑法条文的存在方式反映了中国法律传统中民事问题刑事化的典型观念。
