| 摘 要： | 单位犯罪主体的出现,使以自然人为中心的刑法理论开始了分化和嬗变。从单位自首的逻辑起点、单位自首制度的功利动因、单位自首法律的依据等角度探讨单位自首客观存在的根由,对单位自首成立之要件中的投案主体二元性及投案意志二元性及单位犯罪处罚原则等问题进行分析,单位犯罪自首与自然人犯罪自首相比有其特殊的一面,在今后的刑法修改时应对单位自首作出单独规定为宜。

| Abstract: | As unit crime appears,the natural-man-centered criminal law theory begins to change.This paper intends to begin with the logical start,practical motivation and law basis to discuss the reason of its existence,then further discuss the surrender body's two aspects,the two aspects of surrender wishes and its principle of punishment.However,compared with natural man's surrender,unit surrender has its own particular aspect and it is better to make a specific rule about it in its amendment in the future. |
