侦查监督工作中纠正违法制度的立法思考

纠正违法制度作为检察机关法律监督的重要内容和主要形式,发挥着重要作用。但由于缺乏全面系统的法律规定及运行机制,存在知情渠道不畅、监督标准不一、监督形式不规范、监督手段单一乏力等诸多问题。立法应当明确检察机关纠正侦查活动违法制度的法律地位、法律效力和适用范围,同时规定救济途径、监督保障机制,从而对我国的纠正违法制度进行全面化、系统化的构建和完善。

Legislative Thoughts on Correcting the Illegal System in Investigation and Supervision Work

Correcting the illegal system, as the important content and main form of the legal supervision of procurato- rial organs, plays an important role. However, due to the lack of comprehensive and systematic legal provisions and operation mechanism, there are many problems such as poor access to knowledge, different standards of supervision, irregular forms of supervision, single weak means of supervision, etc. Legislation should define the legal status, legal effect, and scope of application of procuratorial organs＇ correcting the illegal system in investigation and supervi- sion, and then provide remedy ways and supervisory safeguard mechanisms so as to construct and improve our cor- recting illegal system comprehensively and systematically.
