| 摘 要： | 科学鉴定证据在现代诉讼中发挥着无可替代的作用。但是科学鉴定证据专家不是科学的法官,法官裁决也不是科学鉴定证据的翻版。纵观两大法系,其科学鉴定证据制度的形成有不同的成因,也提供了有益的借鉴和警示,如何合理地引进、吸收和构建,不仅是一种技术或者事实问题,也涉及到价值判断问题。

| Abstract: | The scientific expert evaluation,visible in historical retrospect,has irreplaceable function in modem legal procedure. However the experts who make the scientific conclusions are not judges of science,and the judges'decisions may not image the scientific expert evaluation.Relevant rules of the Anglo-American and continental legal system have different cause of formation while are both referential and suggestive.It is not only a matter of technique or fact but also an issue of valuation to rationally in- troduce in,assimilate and construct the rules. |
