| 摘 要： | 近年来,非法传销的违法犯罪活动愈演愈烈,严重扰乱了社会主义市场经济秩序和社会秩序,影响社会稳定,损害人民利益。对于严重非法传销的犯罪行为,我国刑法立法的现状显得过于苍白,非法传销行为亟需刑法予以规制。我国在打击非法传销行为刑事立法中采用了附属性刑法型和司法解释型,应当科学合理地对非法传销行为进行刑事立法,更好地打击非法传销行为,发挥刑法的功能和价值作用。
