| Abstract: | The frequently appeared "legal loophole" cases are not only the contingency of the special things, but also the causes between social highly developing and the comparative slowly legislating or the results of limitations of "legal loophole" cases, many thorny problems, such as, "unfair judicature", "long-term cases unsolved" etc, appear often. The article analyses and points out that we can draw on the judge-made Law of the Common Law System to solve the above problems. |
