| 摘 要： | 民事权利保护的请求权体系是民法请求权体系中的一个组成部分,其作用在于保护民事权利不受侵害,以及对受到的侵害的及时救济。民事权利保护的请求权体系由原权请求权和次生请求权两个系统组成。它们之间的关系是部分竞合关系。确定这样的体系,理清它们之间的关系,对于加强民事主体的权利保护,具有极为重要的意义。

| Abstract: | The claim system of protection of the civil right is an important part in the claim system of civil law.It can protect the civil right from encroachment and relieve the encroached civil right timely.It is composed of the claim of the original right and the claim of the derivative right.Relationship is part choice between the claim of the original right and the claim of the derivative right.Defining so system and clearing their relation has of important significance to strengthen protection of the right. |
