虚拟货币洗钱犯罪的风险剖析及治理策略

文章对比了虚拟货币与法定数字货币的概念特征和差异,剖析虚拟货币所蕴含的洗钱犯罪风险,结合司法实践的案例,将虚拟货币洗钱类型化为两种模式,并详细剖析有第三方共同参与进行虚拟货币洗钱犯罪的责任归属;结合《民法典》对虚拟财产的承认以及《刑法修正案(十一)》对洗钱犯罪的修改,提出应该辩证看待虚拟货币的利弊长短,在学习借鉴欧盟、美国、日本等国对虚拟货币的监管经验的基础上,呼吁出台网络虚拟货币监管条例,对虚拟货币的法律属性予以明确,提升对金融科技的监管水平,遏制虚拟货币洗钱犯罪的发生。

Risk Analysis and Management Strategy of Using Virtual Currency for Money Laundering Crimes

This article compares the conceptual features and differences between virtual currency and legal digital currency,analyzes the risk of money laundering crimes contained in virtual currency,classifies the use of Virtual Currency for money laundering crimes into two models on the basis of judicial practice,and analyzes the attribution of responsibility forthe participation of a third party in the use of virtual currency for money laundering crimes.In addition,combining the recognition of virtual property in the Civil Code and modification of money laundering crimes in the eleventh amendment of Criminal Law,the pros and cons of virtual currency should be viewed dialectically.At the same time,based on the experience of the European Union,the United States,Japan and other countries in the supervision of virtual currency,we call for the promulgation of theRegulations on the Supervision of Virtual Currencyin order to confirm the legal attribute of virtual currency,improve the supervsion of financial technology further,and reduce the use of virtual currency for money laundering crimes.
