| 摘 要： | 文章从人权理念和刑罚执行的灵活性两方面分析了设立暂予监外执行制度的价值基础。同时,就法典规定暂予监外执行的模糊问题,提出了相关建议,如：罪犯在暂予监外执行期间脱逃,其行为已构成犯罪;要明确不计入执行刑期的追诉期限;刑事诉讼管辖以属地管辖为主原则。

| Abstract: | The article analyzes the value basis of establishing the system of temporary execution outside prison through the concept of human rights and the flexibility of penalty execution.Meanwhile,it provides relevant recommendations on the ambiguities in the code on temporary execution outside prison,such as the criminals＇ behavior having constituted a crime when escaping during temporary execution outside prison;making clear the period for prosecution which is not included in the execution of sentence;the principle that criminal proceedings is under the territorial jurisdiction. |
