| 摘 要： | 注意义务在侵权法中处于举足轻重的地位,其良好构建能够更好地平衡加害人、受害人和国家之间的利益。我国引进英美法系的注意义务,以注意义务为核心建立侵权责任的构成要件,完善侵权行为法,可以缩短与英美等法制发达国家在法律制度上的差距,更好地维护受害人的利益。

| Abstract: | Duty of care occupies in a pivotal position in tort law, whose good construction can better balance the in- terests among the offenders, victims, and country. Through introducing the duty of care from Anglo - American law system, establishing the constitutive elements of tort liability with the duty of care as its core, and improving tort law, we can shorten the gaps in the legal system to that of Britain, America, and other countries with developed legal system and better safeguard the interests of victims. |
