| 摘 要： | 《刑法修正案（八）》明确将危险驾驶入罪。危险驾驶罪包括＂追逐竞驶＂和＂醉酒驾驶＂两种行为方式。危险驾驶案件多为醉酒驾驶。实践中,其规定存在着不足。应当扩大醉酒驾驶交通工具的范围、增加情节的限制,完善对危险驾驶罪之醉酒驾驶的刑罚处罚,规范与醉酒驾驶行为相关的机制。

| Abstract: | In ＂Criminal Law Amendment （8） ＂,it is clearly provided that dangerous driving is convicted. D driving crime includes ＂pursuit of competitive driving＂ and ＂drunken driving＂. Most of dangerous driving drunken driving. In practice, there are some deficiencies in its provisions. We should expand the scope of driving modes, increase the restrictions of plot, improve the criminal punishment for drunken driving of d driving crime, and regulate the mechanisms related to drunken driving. |
