| Abstract: | There is a sharp confrontation to the essence of the illegality between erfolgsunwert and handlungsunwert.Under erfolgsunwert position,this article compares and analyzes the differences and similarities between accidental defense and justifiable defense from an objective perspective and then provides a reasonable basis for the determination of accidental defense. |
