| 摘 要： | 我国道路交通事故损害赔偿责任制度总体经历了三个阶段：过错责任原则；无过失责任原则或过错推定责任原则；第三者责任强制保险制度原则。但是，交通事故损害赔偿原则并非完美无缺，它在具体实施中也遇到了一些问题。建立完善的交通事故损害赔偿制度，一要制定专门的《机动车事故损害赔偿法》，二要制定完善的《机动车保险法》，三要加紧制定精神损害赔偿方面的法律、法规。
