法正义价值的人本之维

马克思对人的本质作了全面系统的研究,认为人的类本质是自由自觉的活动,人的现实本质是一切社会关系的总和.在本质上,自由以绝对的形式成为人之存在的前提,而自由的现实化之路充满艰辛.正是在对自由的追求中,人们选择了法.在人类社会生活中,没有绝对无自由的法,也没有绝对不需要法来保障的自由.法的正义价值是人的自由本质在社会制度层面的展开,法在制度层面的最核心价值就是对正义的追求,保护每个人所应得的权利,防止他人滥用权力(权利)干涉自由.

The Just Value of Law for the Safeguard of Nature of People

Marx had studied totally and systematically on the nature of people.He believed that the category nature of people is the conscious activity;the reality nature of people is the sum total of all social relations,there is inner relation between them.In nature,freedom is the prerequisite to the existence of people in the absolute form;there are many obstacles on the realistic way of freedom.People choose law during the course of pursuing freedom.There is no law without freedom absolutely,and there is no freedom without the protection of law.The just value of law is the development of people's freedom nature in the social system aspect,the most core value of law in the system aspect is the pursuit of justice,protecting the reserved right of everyone and preventing others abuse power and interfere freedom.
