中国海事仲裁委员会标准新造船合同初论

从语言、准据法和争议解决方式、新增条款及需要注意的问题等几方面评述了中国海事仲裁委员会标准新造船合同（上海格式）的特点，将其与相关造船标准合同做了比较，对其存在的问题提出了完善建议。上海格式的很多条款实用性强，有助于减少争议、促进合同履行，但也有若干条款在内容或措辞等方面需要加以完善。经过修改完善，上海格式可以成为当事方订立船舶建造合同的良好基础。

Review of the Shanghai Form-- a new shipbuilding standard form of China

From the points of language, applicable law and dispute resolution, newly incorporated provisions and issues to be noted etc. , this paper summarizes and comments on the features of the Shanghai Form, compares relevant provisions thereof with other standard forms and proposes some suggestions of improvement. It is concluded that the Shanghai Form contains useful and instructive provisions but needs to be improved in either contents or wording. Subject to improvement, the Shang- hai Form may be used as a good basis for conclusion of shipbuilding contracts.
