从契约到身份——现代身份权体系的重构

在经历了近代民法的“从身份到契约”之后,现代民法又掀起了“从契约到身份”运动,人类开始了对自由的更高追求。实现人格的实质平等、实现民法的公平正义是“从契约到身份”运动的目标。民法的这一变革相应地引起了现代身份权体系的重新构筑,伴随着传统身份权类型的衰亡,新的身份权类型成为现代身份权体系的中坚,身份权与契约一同承担起规制市场经济主导下的现代社会的重任。

From contract to identification--the reconstruction of modern identification right system

after the process of "from identification to contract" in contemparary civil law, there is the movement of "from contract to identification" in modern civil law. People start to pursue freedom, to realize the equililty in essence of personality,as well as the justice of civil law. The reform in civil law brings to the reconstruction of modern identification right system. With the decline of traditional identification right patterns, new patterns of identification right have become the backbone of modern identification right system. Identification right and contract take on the task of regulating modern society dominated by market economy.
