| 摘 要： | 西方实质主义司法的兴起,有其社会背景和文化原因,它是司法客观性危机的产物,也是社会发展的要求,实质主义司法有其独特的特点和实现路径,其解决纠纷的机理在于利于社会心理的宣泄、和谐秩序的构建、利益冲突、心理诉求的平等关注、对弱者利益的关怀。
