讯问同步录音录像制度的现状、问题及完善

2006年以来，我国各级检察机关在讯问职务犯罪嫌疑人时已全部实施讯问同步录音录像制度，虽然总体收效及反响良好，但也存在若干问题，若不加以改善，将影响该制度内在价值的实现。如讯问同步录音录像的定位、功能和效力，辩方是否拥有启动录音录像当庭播放的请求权等问题需要明确。建议讯问同步录音录像应作为刑诉法中的证据被明文界定；可以反证讯问人员构成犯罪；在国家机密不被泄露的前提下，检察机关应无条件公开讯问同步录音录像；讯问同步录音录像的适用对象应逐渐扩大。
