言词证据的话语分析——法律语言学视角下的解读

刑事司法领域中的讯问笔录是言词证据①的重要内容，它建立在公诉人与犯罪嫌疑人话语交流的基础上，形成于检察官审查案件的记录中。公诉人在言词证据固定中往往不能真实、客观地反应接受讯问者的意图，从而使犯罪嫌疑人在讯问终了时已或多或少的承受了对他不利的法律评价。文章从法律语言学的视角出发，将讯问对话的内容和转化为言词证据之笔录进行比照，分析这一过程给检察机关与犯罪嫌疑人两造②带来的不利局面，最后尝试给出解决问题的办法。

Discourse Analysis on Linguistic Testimonial Evidence——the Interpretation from Perspective on Legal Linguistics

Record of inquiries is the important content in criminal justice area, which establishes on the language exchange between the public prosecutor and suspect, and forms in his record when he hears a case. The public prosecutor cannot objectively and truly reflect the interviewee＇s intention in the linguistic evidence which causes that the suspect bears negative legal evaluation more or less when interrogation ends. From the angle of legal linguistics the author, based on comparison of bilateral language exchange content and transformation, analyzes this process bringing the unfavorable situations of difference between procuratorial organ and suspect. Finally the author tries to supply methods to solve these problems.
