质疑劳动合同单方解除权的平衡性

摘    要:劳动合同的单方解除涉及到合同效力、当事人的合同期待以及利益得失等问题 ,受到当事人和劳动立法、执法机关的高度关切。我国《劳动法》对用人单位和劳动者的单方解除权采取区别对待原则 ,赋予劳动者完全自由的单方解除权 ,严格限制用人单位的单方解除权 ,这对于保护劳动者权益具有理论意义 ,但存在授权不平等、监督困难 ,达不到预期的实施效果。单方解除权的平衡性是合同的内在要求。

Abstract:To rescind a labor contract unilaterally is relevant to the binding force of the contract,the parties' andticipation under the contract,and the loss of interests,which draws the close attention of the parties,and the agencies making labor law or enforcintg the labor law.The Chinese Labor Law makes different provisions on the right to unilaterally rescind a labor contract by the employee or the employer:the employee has the complete freedom while the employer's right is strictly restricted.This has theoretically significant for the protection of the employee's right but has the problems of unbalanced rights and supervision difficulty.It is difficult to achieve the anticipated effects.The balance of the rights of unilateral rescission is an inherent requirement of the contract law.
