This article is part of a larger study undertaken by the authors at the request of UNESCO in view of the development of an international instrument capable of clarifying in which circumstances deliberate destruction of cultural heritage constitutes a violation of international law. A draft instrument in the form of a UNESCO Declaration was finalized at the meeting of experts convened by the UNESCO's Director General in Brussels in the first week of December 2002, with a view to its adoption by the UNESCO General Conference in autumn 2003.
