| 摘 要： | 从法律价值上考察,作为程序之重要组成部分的证据具有外在价值、内在价值及法治价值。证据的外在价值即证据对案件实体问题的正确处理所发挥的价值;证据的内在价值是指证据本身所具有的内在的优秀品质,即是评判证据的收集、审查判断及运用过程是否具有善的品质的道德标准,主要表现为理性、尊严和公平;证据的法治价值是指证据对刑事法治的实现所起的关键性作用。三者共同组成内涵丰富的证据价值体系。

| Abstract: | evidence as a part of procedures has inner, external and legality values. External values of evidence refers to the values which evidences play in treating substantial matters of cases. Internal values of evidences refer to the characters of evidences, that is, good and kind features and moral criterions in evaluating collection, judging and application of evidences, and demonstrate mainly as reasonableness, dignity and equity.The legality values refer to the key role which evidences play in the realization of rule of law in criminal matters. The three make the value system of evidences. |
