| 摘 要： | 共犯关系脱离理论试图解决在共同犯罪成立后，部分共犯人退出共犯关系后应如何评价其刑事责任的问题。共犯关系脱离理论是共同犯罪理论中的重要内容。为了合理地处理实践中出现的共犯关系脱离行为，需要在借鉴国外相关理论的基础上，从理论上对共犯关系脱离的概念、脱离的标准进行合理的界定。

| Abstract: | The theory of withdrawal from joint crime attempt to solve the problem of bow to evaluate the responsibility for criminal offense after their retreating from joint crime. In order to rationally handle the withdrawal from joint crime, we should correctly define the concept, criteria and of the departure from joint crime on the basis of foreign country＇ s research result. |
