网络域名民事纠纷案件受理条件和范围研究

最高人民法院出台的《关于审理涉及计算机网络域名民事纠纷案件适用法律若干问题的解释》对于统一和规范网络域名民事纠纷案件有着积极的意义。但其中“有明确的被告”这一受理条件与域名注册不审查政策存在冲突,致使网络域名管理组织被无休止地作为被告。对此,法律应作出规定,从程序上建立机制,明确网络域名管理组织应当承担责任的条件,以减少其作为被告的可能性。

A Study on Conditions and Scope for Accepting Civil

The Supreme Court's Interpretation of Law Application of Hearing Civil Dispute Cases Concerning Computer Network Domain is of positive meaning for unifying and standardizing dispute cases concerning computer network domain.But the stipulation of having definite defendant conflicts with the policy of no examining of domain registration,which causes the network domain management organizations to be defendants ceaselessly.Therefore,stipulations must be made by laws to establish procedural mechanism and make clear their conditions of undertaking duties for the sake of decreasing the possibilities of being defendants.
