我国社会组织参与法律援助研究

"法律职业并不是一个同质性和自主性的行业团体,而是处在一个由各类市场和国家行为主体所构成的复杂生态系统里。"因此,"理想状态下,法律援助计划如果能吸纳不同类型服务提供者会更好地实现改进司法公正的目标。"我国一直奉行"政府主导、多主体参与"的法律援助政策。社会组织参与法律援助,作为政府法律援助的必要补充和有效延伸。与此同时,政府主导、多元化主体参与包括法律援助在内的社会公共法律服务的提供,是目前中国政府创新社会管理模式、迈向"服务型"政府过程中的重点推进工作之一,也为有中国特色社会主义社会福利提供模式的探索进程增添又一实践素材。以党的十八大、十九大和十八、十九届三中、四中、五中全会精神为指导,以中办、国办《关于完善法律援助制度的意见》为遵循,运用法学有关理论,对我国法律援助理论与制度的完善作重点阐述。梳理社会组织法律援助的优势和面临的困境,并试图寻找解决路径。

A Research on Participating in Legal Aid of China's Social Organization

"The legal profession is not a homogeneous and autonomous trade group,but in a complex ecosystem composed of various market and state actors."Therefore,"ideally,a legal aid program would be better able to achieve its goal of improving justice if it could include different types of service providers."China has been pursuing the legal aid policy of"government-led and multi-subject participation".The participation of social organizations in legal aid is a necessary supplement and effective extension of the government s legal aid.At the same time,social public law including legal aid services with the government leading and diversified subject to participate in is one of the key work in the process of the innovation of social management mode and Chinese government towards"service-oriented government".It also adds another practical material for the exploration of social welfare pattern of socialism with Chinese characteristics.Guided by the spirit of the 18th CPC national congress,the 19th CPC national congress,the 18th CPC national congress,the 3rd CPC national congress,the 4th CPC national congress and the 5 th CPC national congress,and the opinions on improving the legal aid system issued by the office of the state council of the CPC central committee,this paper focuses on the improvement of the legal aid theory and system in China by applying relevant theories of law.The advantages and difficulties of legal aid in social organization are sort out in order to find a solution.
