职业化视域下警察职业保障的法治化进路

警察作为一项职业,其本身体现出强烈的特殊性,从业者也需要与之相对的特殊管理制度。警察的职业保障制度不应限于保障个别的特殊之处,而应扩大其内涵,将与警察职业相关的管理均纳入其中。当前,警察职业保障制度法治化存在立法主体不统一、立法定位不准确、警民关系有待进一步提升等问题。对此,应从国家立法、警察执法、群众守法等三维进路,实现警察职业保障制度的法治化。

Research on the Legalization of Police Professional Security System from the Perspective of Professionalization

As a profession,police manifests its strong particularity,for that reason,a special management system must be established.Police professional security system should not be limited to guaranteeing individual particularities,but should expand its content and incorporate management related to the occupation of police.There exist problems in current legalization of police occupational security system such as the disunity of legislative subjects,inaccuracy of legislative positioning,and disharmony of police-civil relations.It is necessary to realize the legalization of police occupational security system through three approaches of national legislation,police law enforcement,and masses’law abiding.
