公共卫生风险下的医疗数据流通及其治理变革

作为公共卫生治理现代化进程中的重要领域之一,医疗数据流通已经在市场化操作、公益性追求以及立法实践等方面得到体现,并且获得了一定的治理成效。但受到医疗数据中个人信息的影响,国家同时也在承担着医疗数据流通的市场化治理风险、立法成效风险和信用风险,由此引发我国在"数据治理"上的整体性变革。为了进一步推动公共卫生治理体系与治理能力的现代化,提升公共健康水平,我国应该采取利用主权区块链完善医疗数据信用机制,重塑数据监管模式,并完善医疗数据的知识产权保护机制,最终形成个人与社会共享受益的新型数据治理模式。

Medical Data Circulation and its Governance Reform Under the Risk of Public Health

As one of the important fields in the process of modernization of public health governance,medical data circulation has been reflected in the aspects of marketoriented operation,public welfare pursuit and legislative practice,and has achieved some governance results.However,affected by the privacy characteristics of medical data,the state is also bearing the market-oriented governance risk,legislative effectiveness risk and credit risk of medical data circulation,which leads to the overall reform of"data governance"in China.In order to further promote the modernization of public health governance system and governance capacity,and improve the level of public health,China should take advantage of the sovereign blockchain to improve the credit mechanism of medical data,reshape the data supervision mode,and improve the intellectual property protection mechanism of medical data,so as to finally form a new data governance mode of sharing benefits between individuals and society.
