论国家制定法和藏族习惯法的融合与对接——以法律多元主义为视角

本文通过对“活法”和习惯法、活法和“行动中的法”的进一步的区分，明确了活法的概念，指出习惯法是活法的重要组成部分，然后重点对广大藏族聚居区国家制定法所遭遇的尴尬进行了剖析，得出赔命价、赔血价、“盗一罚三”等民族习惯法有其存在的合理性，呼吁在新的历史条件下国家制定法与传统习惯法的融合和对接。

On the Integration and Docking between Constitutional Law and Customary Law of Tibetan Ethnic Minority--View it from the Visual Angle of Law Pluralism

This paper,by distinguish the live law and the customary law,as well as the live law and the law in action deeply, clears the live law and points out that the customary law is one of the important component of it. Furthermore, through analyze of the awkward that constitutional law in Tibetan facing,and deduces that customary law is reasonable in certain extent ,such as the compensating for the life, and the compensating for the blood, and one steal three punish and so on. We hereby,appealing that the integration and docking between constitutional law and customary law in the modern society.
