摘    要:就业促进立法是近期我国劳动与社会立法领域的一件大事,在该法的立法起草和论证过程中,要着重关注几个焦点问题,在就业平等与反歧视方面,用人单位、政府和其他社会组织应分别承担何种程度与范围的义务与责任,劳动就业灵活性与稳定性之间的关系如何处理,如何建立与完善用人单位、中介组织、政府和劳动者等各就业关系主体的诚信约束机制,涉外就业关系如何处理等问题。

Abstract:To promote the employment through legislation is an important task recently in the legislative field of labor and society.During the draft and argumentation of this act,several issues became the focus:on the fairness and anti-discrimination in the employment,what kind of responsibilities should the employer,government and the other social organization take and how much responsibility each of them should take? How to deal with the relationship between the flexibility and the stability in the employment? How to build the credit system binding the subjects of the employment relationship such as the employer,employment agency,government and the employee? How to deal with the international employment relationships?
