法治视域下的行政权主体研究

依法行政的前提之一是行政权主体的明晰。行政权主体的明晰将有助于服务政府的建构和法治社会的形成。然而,在我国公法研究中,学者对行政权主体问题缺乏必要的深入研究。从法治的角度来看行政权主体是一个多层次系统的概念,包括归属主体、配置主体、承载主体和行使主体四个层次。其中,人民是行政权的归属主体;立法机关是行政权的配置主体;行政主体是行政权的承载主体;行政人是行政权的行使主体。

Study on the Subject of the Administrative Power in the View of Rule of Law

The premise of administration by law is to know the subject of the administrative power profoundly,which will contribute to build a service government and to achieve legal society.It hasn't been studied it profoundly in our public law study.The subject of the administrative power is a systematic concept,including the owner,the subject of distribution,the medium and the subject of execution.People are the owner of the administrative power.Legislature is the subject of distribution.The subject of administrative is the medium.The executive personnel is the subject of execution.
