论我国经营性划拨土地使用权制度之改造

摘    要:经营性划拔土地使用权是我国原有的划拨土地在适应市场经济发展过程中被法律在某种程度上加以改造的产物.相关立法在其取得上同时存在"无偿论"和"有偿论"两种相对立的观念,造成法律适用上的混乱和当事人间利益的失衡;且法律设计上该种权利的受限制性与市场的流动性要求也不相符.因此,应以"充分的有偿论"和物尽其用的思想对现行经营性划拔土地使用权立法进行修订,国家对特殊企业的扶持也应转为以出让的土地使用权出资的方式实行.

Abstract:The commercial transfer of land-use-right is,to some degree,the outcome of the law reform during the development of the appropriated land formerly to adapt to market economy.The opposing conceptions of "no consideration" and "consideration" when obtaining the land,which coexist in the law,cause the confusion of the application of law and the inbalance of the interests between the parties.Meanwhile, the conditionality of the rights designed in the law does not agree with the demand of the liquidity of the market either.Therefore,the current law should be amended with the idea of "sufficient consideration" and making the best use of everything.The way of supporting special corporation in our country should also be transformed to the way of financial contribution through transferring land-use-right.
