秘密侦查论略

当前严峻的犯罪态势使传统侦查模式不能适应犯罪控制的需要 ,秘密侦查制度的法治化势在必行。秘密侦查的立法依据在于其诉讼功能和防卫功能中所体现的基本价值。应以国外秘密侦查模式为借鉴 ,从立法上解决我国秘密侦查制度中秘密侦查案件范围、对象、时间期限、审批程序、结果处理等问题。

A Sketchy Study on the Secret Criminal Investigation

Current situation of crime is so grim, that the traditional investigation mode could not satisfy the need of crime control. Legalization of secret investigation has become imperative. Legislative basis for secret investigation lies in its basic value in lawsuit function and defense function. By using foreign investigation mode for reference and taking Chinese legislation as basis, this article gives a legislative solution to investigative measures, criminal range, target, deadline, approval procedure, result resolution, among others, in Chinese secret investigative system.
