The Rise of Commentary and the Decline of Textbooks:Fifteen Observations on the Development of Legal Document Forms in Germany in the 20th Century

Legal commentary is the product of German codification movement.Its emergence makes legal science no longer divorced from judicial practice.Because the interpretation of the current law is always based on case law,legal commentary has replaced most legal works and textbooks and become the standard form of German legal literature,and unites jurists and legal practitioners on the platform of commentary.As an important communication carrier of legal dogma,legal commentary is committed to grafting the connection between legal science and judicial judgment,and pursuing the internal systematization of written law to make the statute more practical.The hundred year development history of legal commentary not only achieved law as a skill,but also contributed to the understanding of current law as the product of the integration of written law and case law,and promoted the continuation of law in this sense.
