| 摘 要： | 对向犯是一种特殊的犯罪类型,其内涵的界定在国内外争议较大。本文通过对对向犯的上位概念必要共犯理论的分析,揭示对向犯的本质,并梳理目前学界有关对向犯的研究成果,试图突破现有的理论窠臼,从行为主体和对向关系两方面来探究对向犯的形成结构。

| Abstract: | Correspondence Offense is a special type of crime, it＇s definition has great controversy at home and abroad. Based on the Correspondence Offense superordinate concept ＂essential accomplice＂ theoretical analysis, reveal the nature of the Correspondence Offense. And combing the academic world research achievement on Correspondence Offense, trying to break the stereotype of existing theories. This article explores the implications of the Correspondence Offenseshould from the actors and between two aspects relationship. |
