公共住房保障制度若干法律问题探微

在倡导给付行政、福利国家的今天,公共住房保障俨然已成为政府改善民生的重要一环,加快保障性住房建设,让百姓居者有其屋不仅承载着公众的热切期盼,更是政府不可推卸的责任。而在乐见我国大规模推进保障性住房建设的同时,与之配套的公共住房保障制度却存在诸如法律属性模糊、供需矛盾突出、分配机制混乱等理论与制度上的问题,亟待我们从行政法的视角深入解析,以期通过理论更新和制度改良来弥补上述缺憾。

Several Legal Thoughts on Public Housing Security System

With the advocation of Service Administration and Welf are State,Public housing security has really become an important part of the improvement about people＇s livelihood,conducted by the government.Accelerating the construction of affordable housing,so as to meet people＇s housing needs,is not only the eager hope of the public,but also the inescapable obligation of our government.While we are happy to see a large number of affordable houses being builded,the corresponding public housing security,however,has some theoretical and institutional problems,such as the unclear legal nature, serious contradictions between supply and demand,unordered allocation mechanisms and so on.We need to deeply analyze through perspective of Administrative law,and remedy above defects by academic updates and system improvements.
