| 摘 要： | 随着互联网的不断发展,作为社交网站主要形式的微博在带来著作权扩张的同时,也改变了作品传播的方式,并对著作权的保护提出了挑战.微博作品虽然短小,但只要符合独创性标准,应该享有著作权.基于微博的技术原理,微博平台对原始微博的转发不涉及复制和网络传播;对在先转发的转发构成对在先转发者评论内容的复制和网络传播.转载他人作品的行为构成侵权.

| Abstract: | With the development of network,Microblogging as the main form of social networking sites results expansion of copyright,change the way of communicating works.It also presents a challenge of copyright protection.Ahhrough microblogging works is short,if they meet the criteria of originality,they can be protected by Copyright Law.Because of the technical rules of microblogging,forwarding does not involve copying and dissemination.Reproducing the works of others constitutes infringement. |
