| 摘 要： | 新刑诉法规定检察机关可以在审查起诉阶段适用附条件不起诉制度,该制度是各国刑事司法发展过程中所形成的一项新兴制度.本文在阐述附条件不起诉制度的渊源以及对世界范围内比较通行的做法进行比较研究,借此探讨我国的附条件不起诉制度的内在价值,提出现行的附条件不起诉制度的不足之处,并提出建议和解决方案.

| Abstract: | New Criminal Procedure Law provides that in the prosecution phase prosecutors can use the non -prosecution system, this system is formed in the process of the development of inter national criminal justice system. This paper describes the origin of condi- tional non - prosecution system and studies comparatively about common practice within the scope of the world, in order to investigate the intrinsic value of the conditional non - prosecution system. This paper also pointed out the inadequacies of the prosecution system, and to make recommendations and solutions. |
