| 摘 要： | 同步录音录像资料作为一种记录侦查询问过程、固定言词证据、保证程序合法的材料和方式,日益凸显着它的证据价值.然而,其证据属性在新《刑事诉讼法》中并未明确.但是,新《刑事诉讼法》认定证据的标准已经更具开放性.同步录音录像资料的证据价值不仅具有司法实践的基础,更具有证据的客观性、关联性、合法性等基本属性,其证据地位有待通过司法解释或进一步立法予以明确.

| Abstract: | Simultaneous audio video information as a record of an investigative interview, fixed oral evidence, assurance procedures and legal materials, ？ Growing evidence of its value.？ However, evidence of its properties in the new code of criminal procedure does not clear.？ However, standards found evidence in the new criminal procedure law has been more open.？ Evidentiary value of simultaneous audio video not only has the basis of judicial practice, more evidence of basic properties such as objectivity, relevance, legality, its evidential status pending further legislative or by judicial interpretation to be made clear. |
