| 摘 要： | 在中国《婚姻法》中,知识产权得到了与其他财产权不同的处理方式,这一规定存在着模糊性和不合理性。从知识产权的特征和夫妻共同财产制角度出发,婚前取得的知识产权婚后收益属于知识产权人个人财产,但应当考虑到婚后经营管理对收益的贡献;婚后取得知识产权及其收益属于夫妻共有财产;在离婚时应当将知识产权按照财产权的一般分配规则进行分割,但应当注意人身权的专属性和未发表作品著作权的特殊分割规则。
