| 摘 要： | 保险法诚信原则的确立基础可以从保险的历史、合同性质、产品功能来考察。保险法诚信原则的实现是通过投保人和保险人对保险法诚信原则的履行来完成的。现行保险法的诚实信用原则应该改为最大诚信原则,该原则在我国的保险法体系中尚有许多不足之处需要完善。

| Abstract: | The foundation of good faith principle in insurance act is laid by insurance history,insurance contract nature and insurance product function.The fulfillment of the principle depends on the insurant's and the insurer's living up to good faith.The principle of good faith in contemporary insurance act should be amended into the utmost good faith principle;meanwhile it has a lot of defects desiderating a perfected treatment. |
