民法学中若干法律概念的逻辑思考

法学是研究国家和法的科学,同时又是一门应用逻辑学.民法学作为一门重要的部门法学是从民事法律方面向人们明确概念,叙述判断,阐述推理的.然而一些民法学教材忽略了思维的基本原理、基本规律,体现在具体的民法学教材中,概念不明确、判断不恰当、推理不合乎逻辑、论证没有说服力的现象时有发生.从逻辑角度分析一些民法学教材在明确概念方面所存在的逻辑错误纠正表述这些民法学概念的语词,这样才能揭示其内涵,确定其外延,使其既符合法律,又合乎逻辑.

The Logic Thinking of Civil Law Conceptions

Law Science is not only a science which researches a nation and law,but also an applied logic subject.As an important departmental law,civil law makes the conception,recounts the judgment and elaborates the illation from the side of civil cases.However,in some civil law teaching materials,the basic thinking principles and basic rules are usually ignored;the conceptions are not enough definite,the judgments are not very right,the ratiocination does not accord with the logics and the demonstration doesn't have strong persuasion.From the logistics point of view,this article tries to analyze some logic mistakes which existed in the daily civil law teaching materials and talks about how to open out the inner meanings of the civil law conceptions to ensure the extension of them and make them accord with law principles and the logics.
