| 摘 要： | 惩罚性赔偿制度是一种兼具惩罚、补偿和威慑功能的责任制度。我国已在消费者权益保护法中引入了该项制度。但近二十五年的实践证明了我国关于该制度的规定存在一定的缺陷。本文通过分析引发问题的原因，认为应该从其适用范围和赔偿数额方面着手，进一步完善该制度。

| Abstract: | Punitive damages system is an accountability system, which performs punitive compensatory and deterrent functions. This system has been introduced into the law of the PRC on the protection of consumers＇ rights and interests. But the practice of tweenty-five years ago has improved that there are some flaws in the system.Analyzing the causes of the problem, the article suggests that we should take some of the measures about the applicable scope and the amount of the compensation to perfect this system. |
