民事强制执行法与其他部门法的关系

为了规范和有效指导民事强制执行活动,必须建立完善的民事强制执行制度,其中最重要的就是制定民事强制执行法。为了制定一部科学、完备的民事强制执行法,除了应对其立法宗旨、基本原则、执行程序等内部相关问题进行具体分析外,还应对其外围的一些问题进行法学基础理论上的深入探讨,民事强制执行法与其他部门法的关系即为其中的一个部分。民事强制执行法应是以宪法的立法精神为指导,法律效力在宪法之下的独立的部门法。它与民事诉讼法既有明显区别又有着非常密切的联系。它与刑事强制执行法、行政强制执行法共同组成了广义的强制执行法体系。

The Civil Mandatory Executive Law and Its Relationship with Other Departmental Law

In the purpose of regulating and efficiently instructing the Civil Mandatory Execution,the establishment of a perfect Civil Mandatory Executive System is indispensable,in which the institution of Civil Mandatory Executive Law is of the uttermost importance.In order to set down such a scientific and perfect regulation,the deeper research based on the underpinning of law is necessary,in addition to the concrete analysis of the inner problems in the legislative aim,basic principles and executive procedures,etc.And the relationship between the Civil Mandatory Executive Law and other departmental law is one of the target researches.The Civil Mandatory Executive Law,with its force lower than Constitution,is supposed to be an independent departmental law in the guidance of legislative spirit of Constitution.It is closely related with the Civil Procedure,as well as their obvious difference between them.Together with Criminal Mandatory Executive Law and Administrative Mandatory Law,it composes the extensive Mandatory Executive System.
