摘    要:中国大陆学界关于涉外劳动合同法律适用存在不同观点。从世界各国国际私法立法及合同法律适用的国际公约来看,当事人意思自治原则是已得到全世界普遍承认的一个国际私法原则。但绝大多数法学家都认为当事人自主选择只能在任意法范围内进行,而不得违背法律中的强制性规定。“直接适用的法”是对当事人意思自治选择合同准据法的限制。“直接适用的法”在我国有关法律法规中已有所体现,但仍存在问题,故需要完善有关涉外劳动合同关系的法律适用的立法。

Abstract:In the academic circles of mainland China,there are different opinions on directly applicable laws to labor contract concerning foreigners.In view of international private law legislation of the world and international convention applicable to contract law,the principle of suggesting autonomy of the parties is a principle of international private law recognized at large.However,most of specialist of law thinks that self-determination of the parties should be restrained in the range of arbitrariness law and could not violate the forcing provisions.'Directly applicable law' is a restriction of the suggesting autonomy of the parties to choose contract criterion law.'Directly applicable law' has been embodied in concerning laws of China but with some problems need to be resolved.
