| 摘 要： | 在当前构建社会主义和谐社会的背景之下，对弱势群体提供法律保护具有正当性。这种正当性可以通过两个方面来说明，一是在法的价值层面上，对弱势群体提供法律保护是实现实质平等的必然要求；二是在法的实现层面上，对弱势群体提供诉讼制度的有效实现是体现法律正义性的客观要求。

| Abstract: | Under the background of building a socialist harmonious society,it is valid to provide legal protection for the vulnerable groups,which can be illustrated through two aspects: as to the the value of law,one is to achieve the inevitable requirement of real equality in law,and as to the achievement of law,the other is the necessity to realize the procedure system. |
