论交通事故损害赔偿责任承担及主体确定

在我国，近几年发生的交通事故均数以十万计，大量交通事故及其严重的损害后果，带给交通事故直接当事人（包括侵害者与受害者）无法承受的压力，也使交通事故的事前防范和事后处理显得尤为重要。我国《道路交通安全法》在认定赔偿责任主体方面还不够完善，从而导致在审判实务中，部分交通事故损害赔偿案件认定赔偿责任主体不当。本文通过对交通事故损害赔偿归责原则和责任主体确定标准的分析探讨，理清实践中赔偿主体确定的难点问题。

On Ascertaining Compensational Liability and Subject in Traffic Accidents Damages

In our nation, especially in recent years, traffic accidents have amounted to hundreds of thousands. The large number of traffic accidents and serious result of traffic accidents directly imposed to the parties concerned （including invader and victims） is unbearable, which indicates that traffic accident prevention and post- treatment appear to be particularly important. However, China＇s ＂Road Traffic Safety Law＂ is not perfect in confirmation of compensation of responsibility subject, which causes in trial practices, part of the traffic accident damages cases can not correctly assert compensational responsibility subject. Based on the traffic accident damages criterion of liability and the analysis of the standard of responsible subject, the author sorts out the key points in ascertaining compensational subiect.
