最优化刑事政策体系的经济学分析

从经济学角度来讲,最优化的刑事政策是刑事法投入边际成本等于刑事法边际收益,达到净收益的最大。因此,过于严格的刑事政策和过于宽缓的刑事政策都是低效不经济的,只有建构二元刑事政策体系才是理智之选。所谓二元刑事政策,即为针对脱轨行为和犯罪行为采用不同的反应机制,结合具体情况确定采取社会反应或国家反应,充分发挥社会调控手段的灵活性与多样性,既可降低投入成本,又可使刑事法高效运作。

To Analyze the Superior Criminal Policy System from Viewpoints of Economics

From the viewpoints of economics,the superior criminal policy system makes the marginal cost equal to marginal revenue of criminal law to maximize the pure revenue.Both over-hard criminal policy and over-lenient criminal policy are low efficiency and not economical,so it is reasonable to set up a binary criminal policy system,which means responding to derailed behaviors and criminal conducts with different reaction mechanism,making a decision to adopt social response or national response according to specific conditions,exerting the flexibilities,multiplicities of social adjustment and control sufficiently so that it can minimize the cost and urge criminal law to operate with high efficiency.
