| 摘 要： | 确保植物新品种的不断推出是加强我国农业国际竞争力的有效措施之一.植物新品种有别于一般知识产权的客体,需要进行特殊的立法予以保护.目前世界上主要存在多轨制保护模式及专门法保护模式两种不同的模式,各国在品种权及其限制的具体内容上也各有相异之处,我国亦具有自己的特点,完善现有法律制度,以更好地为农业经济的发展服务.
