| 摘 要： | 平行进口的出现引起了平行进口商与知识产权人之间的法律争议。为了从法理上解决这一争议 ,人们往往求助于权利用尽理论。然而 ,权利用尽的空间特性决定了它根本无法解决平行进口问题。从法学理论上来讲 ,只有进口权理论才能正确地解决这一问题。

| Abstract: | Parallel import is an international trade problem which relates to intellectual property,its emergence causes the legal rights conflict which occur between parallel import merchants and owners of intellectual property.To solve this conflict,people often resort to Exhaustion of Rights.But,in fact,its space properties determine its disability to solve this problem.From the angle of legal science,it can only be solved by the theory of import rights. |
